ATS products carry a ONE (1), THREE (3), or FIVE (5) year / Unlimited Mileage warranty, unless otherwise specified for a particular product. Please refer to each product's specific warranty terms and conditions below.
All ATS warranties are parts‑only warranties, unless otherwise specified. They do not cover any labor, fluids, taxes, or shop supplies of any kind.
ATS warranties do not cover consequential damages and do not warranty or cover any other parts beyond the replacement or repair (at ATS' discretion) of ATS‑branded components or parts.
All ATS warranties are non‑transferable during the original warranty period.
ATS may amend this Warranty from time to time, at its sole discretion, to keep up with changing business conditions and technology.
Arbitration. Except as expressly provided otherwise in this Agreement, any dispute, claim, or controversy arising out of or relating to this Agreement, the parties' relationship, or any breach, termination, enforcement, interpretation, or validity of this Agreement (collectively, "Disputes") shall be resolved exclusively and finally by binding arbitration. The arbitration shall be administered by the American Arbitration Association ("AAA") (or another mutually agreed arbitration provider) in accordance with its applicable rules then in effect. The arbitration shall be conducted before a single arbitrator, and the exclusive seat and venue of the arbitration shall be in Jefferson County, Colorado. The arbitrator shall have the authority to award any relief available in a court of competent jurisdiction, subject to any limitations set forth in this Agreement. Judgment on the arbitrator's award may be entered in any court having jurisdiction.
Governing Law. This Agreement and any Disputes shall be governed by and construed in accordance with the laws of the State of Colorado, without giving effect to any choice or conflict of law provision or rule.
Forum for Litigation if Arbitration Is Unavailable. To the extent any Dispute (or any portion thereof) is determined not to be subject to arbitration, or if the agreement to arbitrate is found unenforceable in whole or in part, the parties agree that any such Dispute shall be brought exclusively in the state courts located in Jefferson County, Colorado, or, if federal jurisdiction exists, in the United States District Court for the District of Colorado, sitting in or nearest to Jefferson County, Colorado. Each party irrevocably submits to the personal jurisdiction of such courts and waives any objection to venue or forum, including any claim of inconvenient forum.
WAIVER OF JURY TRIAL. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EACH PARTY KNOWINGLY, VOLUNTARILY, AND IRREVOCABLY WAIVES ANY RIGHT TO A TRIAL BY JURY IN ANY DISPUTE, WHETHER SUCH DISPUTE IS SUBJECT TO ARBITRATION OR, TO THE EXTENT PERMITTED HEREIN, LITIGATED IN COURT.
Provisional and Injunctive Relief. Notwithstanding the foregoing agreement to arbitrate, either party may seek temporary, preliminary, or permanent injunctive or other equitable relief in a court of competent jurisdiction located in Jefferson County, Colorado, for the limited purpose of preventing or addressing actual or threatened irreparable harm, without waiving its right to have any underlying Dispute resolved by arbitration as provided above.
The consumer must contact ATS Diesel Performance to register all ATS product(s). Registration is required to activate the ATS warranty.
ATS must have the warranty registration information on file for each warrantable product in order for that product to receive any warranty coverage beyond the default.
If the consumer does not register their product with ATS, the warranty is limited to a parts‑only warranty valid for one (1) year (or less as specified below for certain products) from the date of purchase.
Contact ATS first, before any diagnostics or repairs are performed. This is required to help ensure that subsequent repairs are eligible for warranty coverage.
ATS must assist in diagnostics to determine the cause of the failure and how to proceed with repairs (if the product is deemed eligible for warranty coverage).
To start a Warranty Claim, the product must be registered with ATS Diesel Performance. When contacting ATS to start a claim, the consumer must have at least one of the following:
Once a failure is confirmed and ATS determines that the item(s) are eligible to be covered under warranty, ATS will issue a Return Authorization (RA) and a Warranty Claim Number (WA). After receiving these, there are two options for processing the warranty:
If the consumer requires immediate service, the consumer may purchase replacement item(s) up front and then return the damaged/defective parts to ATS for inspection and a possible refund.
In this case, the consumer must pay full MSRP, any applicable core charges, plus shipping to and from ATS.
Once the item(s) are returned, ATS will inspect them to determine warranty coverage and will process refunds as follows:
ATS automatic transmission packages come with a standard 3‑year / Unlimited Mileage parts‑only warranty.
This Warranty does not apply to any automatic transmission that has been:
This Warranty does not apply to any automatic transmission that has been improperly repaired, maintained, or altered by the owner or the owner's agent/technician. This includes, but is not limited to, the following situations:
Vehicles used for racing, vehicles that are heavily modified (such as those with oversized tires of 37‑inch diameter or larger), engines at or above 600 HP, or improperly tuned engines that cause the transmission to operate in the wrong gear are not eligible for any type of labor or shipping coverage under any circumstance.
Damage to the gear train due to insufficient lubrication is not covered if caused by:
Non‑updated snap‑in connectors in cooler lines (Dodge specific: 1994–1998.5 models must be upgraded to screw‑in cooler lines) are excluded from coverage if they cause damage.
Most importantly, all transmission shafts are excluded from coverage under this Warranty on any transmission due to the potential for certain situations to impose stress loads beyond the structural capability of the shaft.
The consumer or end user may purchase an exclusive ATS Extended Warranty for an ATS automatic transmission, as follows:
ATS 2‑Year Extended Parts Warranty, providing a total of 5 years of parts coverage (1‑year standard warranty plus 2‑year extension plus any additional specified coverage, for a total of 5 years).
Specific terms, eligibility requirements, and pricing for the extended warranty are determined by ATS and may be updated from time to time at ATS' sole discretion.
ATS torque converters ("Converters") carry a 3‑year / Unlimited Mileage parts‑only warranty.
Shipping and labor are not covered under any circumstances.
This Warranty does not apply to any Converter that has been:
This Warranty does not apply to any Converter that has been improperly repaired, maintained, or altered by the owner or the owner's agent/technician. This includes, but is not limited to:
ATS manual transmissions carry a 1‑year / Unlimited Mileage warranty on parts.
ATS will not pay for any fluids replaced in the event of a transmission failure. There is no labor or freight warranty coverage on standard (manual) transmissions.
Manual transmission shafts and gears are not covered by this Warranty on any transmission due to the capability of certain situations to cause stress loads beyond the structural ability of the shaft or gear.
Automatic Transmission Clutch Rebuild Kits (the "Kit") carry a 90‑day, parts‑only warranty, exclusively against manufacturer's defects.
This Warranty does not apply to any Kit that has been:

All ATS Aurora turbochargers carry a limited, parts‑only replacement warranty.
This Warranty does not apply to any Turbo that has been:
This Warranty does not apply to any Turbo that has been improperly repaired, maintained, or altered by the owner or the owner's agent/technician.
The following types of damage are not covered under this Warranty:
In the event of a failure that is not covered under this Warranty, ATS will inspect the Turbo for damage and will charge the consumer only for the hard parts replaced.
Aurora Series Fixed Geometry non‑VFR/VNT Turbochargers ("Turbos") carry a 3‑year / Unlimited Mileage warranty.
All general limitations, exclusions, and conditions applicable to ATS Aurora turbochargers also apply to these Turbos.
Aurora Series VFR/VNT Turbochargers ("Turbos") carry a 3‑year / Unlimited Mileage warranty on the mechanical components of the turbocharger.
The actuator for these Turbos carries a 1‑year warranty.
All general limitations, exclusions, and conditions applicable to ATS Aurora turbochargers also apply to these Turbos and their actuators.
ATS electronics carry a 1‑year warranty.
Unless specifically stated otherwise in product‑specific documentation, this coverage is parts‑only and subject to the general limitations and exclusions contained in this Warranty.
All ATS exhaust manifolds carry a 3‑year parts warranty against cracking.
This Warranty does not cover any coatings or paint, including but not limited to cosmetic or protective finishes.
This clause applies to all parts and products manufactured or assembled by ATS Diesel Performance and located outside of North America (USA, Canada, Mexico).
The parts included in this Warranty clause include, but are not limited to:
This Warranty clause covers parts only. The customer is responsible for all shipping and labor costs.

ATS is not liable for any of the following, whether directly or indirectly resulting from failure of any ATS component:

ATS reserves the exclusive right to determine whether its products have been used for extreme horsepower or race applications and reserves the exclusive right to void this Warranty if its investigation reveals such use.
Aside from the provisions set forth in this statement or in other ATS warranty documents, ATS disclaims any implied warranties of merchantability and fitness for a particular purpose.
ATS disclaims any liability for incidental or consequential damages, including but not limited to:
This Warranty is in lieu of all other warranties or guarantees, express or implied, and shall not extend to any consumer or person other than the original purchaser residing within the continental United States or Canada, except as otherwise specified for international parts‑only coverage.
